These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of these Terms and Conditions and by participating all claimants will be deemed to have accepted and be bound by these Terms and Conditions. Please retain a copy of these Terms and Conditions for your information.

1. Promoter: Unique Caribbean Holidays (UK) Ltd., 2nd Floor Nucleus House, 2 Lower Mortlake Road, Richmond, England, TW9 2JA.

2. Eligibility: This prize (defined below) promotion (“Prize Promotion”) is open and offered to all UK residents who are aged 18 or over, except for anyone directly connected with the planning or administration of the Prize Promotion including Unique Caribbean Holidays (UK) Ltd’s employees, directors, officers, their associated agencies or affiliated companies and their immediate families (spouse, parent, child, sibling, grandparent and/or ‘step’ family).

3. Promotional Period: The Prize Promotion opens at 10:00 AM on 15th January 2024 and closes at 23:59 PM on 31st January 2024.

4. Internet access and a public Instagram account are required for entry. Sign  up for a free Instagram account at www.Instagram.com. Participants are reminded to get the owner's permission before using a computer, device and/or internet-access which is not owned or paid for by the entrant to enter this Prize Promotion. The Promoter will not be liable for any Internet or mobile connection, or other charges incurred in entering this Prize Promotion. 

5.  The entry instructions form part of these Terms and Conditions. By entering, you agree to accept and be bound by these Terms and Conditions and the decisions of the Promoter, which are final and binding in all matters relating to the Prize Promotion.  No correspondence will be entered into. Winning the Prize is contingent upon fulfilling or the fulfilment of all requirements set forth herein.

6.  How to enter

• d. Only entries which follow the entry criteria above will be eligible to win the Sandals Prize Package.

• e. Multiple entries are permitted.

• f. Only the selected entrant whose Instagram account the winning comment is posted from will be the winner.

• g. Please follow @sandals_UK on Instagram until 29th February 2024 in the event that a redraw takes place.

• h. Any entries that the Promoter considers (in its absolute discretion) to be political, dangerous, profane, suggestive, vulgar, offensive, indecent, illegal, racist, copied, offensive (including but not limited to words or symbols that might be considered offensive to individuals of any race, ethnicity, religion, sexual orientation or socioeconomic group) cruel or fraudulent, or infringe on the rights or copyright of others will be immediately disqualified.

• i. The Promoter will not tolerate anyone who posts or is seen to be posting comments via any social media channel or anywhere else during this Promotion that we think are bullying, spiteful or upsetting to other entrants and followers @sandals_UK or directly aimed at us. Anyone acting in this way will be disqualified from the prize promotion.

• j. Proof of sending will not be accepted as proof of delivery or receipt of entry. Incomplete, illegal, misdirected or late entries will not be accepted. The Promoter takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise. 

• m. No third party or bulk entries. Entries via third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified. If it becomes apparent in the reasonable opinion of the Promoter that either a participant or household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data; using multiple Instagram accounts; acting fraudulently or dishonestly in the reasonable opinion of the Promoter; using identities other than their own; creating fake identities or using any other automated or manual means in order to increase that participant's or a household’s entries or otherwise acting in violation of these terms, these participants and their household will be disqualified, and any prize entitlement will be void.

7. Winner Selection:

• a. There will be one (1) winner in total.

• b. All entries will be placed into a random prize draw within 14 working days of the closing date.

• c. The first entry drawn that meets the entry criteria will be the prize winner.

• d. The Promoter reserves the right to not award the prize if there are no entries which meet the entry criteria

8. Winner Notification and verification 

• a. The winner will be contacted via an Instagram Direct Message by @sandals_UK within 14 days of the close of the Promotion Period and notified of their win. The winner will have seven (7) days to claim their prize.

• b. If the winner does not respond within the initial four (4) working days of notification, they will be contacted again via a direct message and given a further three (3) working days to respond. If contact cannot be made, or the prize is not claimed, within seven (7) working days of the initial prize notification date, the prize will be redrawn and awarded to a new winner.

9.  The Sandals Prize Package:

• a. Seven-night (7), all-inclusive stay for two (2) adults at Sandals Grande Antigua in one deluxe room with a king size bed (subject to availability and selected blackout dates – see section 8f for a list of excluded dates).

• b. The resort accommodations are inclusive of all meals, unlimited premium brand beverages, daily and nightly entertainment, an array of land and water sports activities, including scuba diving (for certified divers), snorkelling, Wi-Fi in all rooms and public areas, resort gratuities, resort taxes and resort transfers to and from the selected or designated resort’s airport.

• c. The Sandals Prize Package excludes: Any flights including flights from the UK to the Caribbean, domestic transfers including any internal flights or transportation to the departure airport, hotel stays other than the prize awarded as part of the Prize Promotion, spending money, telephone calls, Red Lane® Spa treatments and services, specialty dining, tours & excursions, inter-island transportation, SCUBA certification courses, island departure taxes and purchases made at the Sandals Resorts Specialty Shops. All expenses and incidental travel costs not expressly stated in the prize package description, including but not limited to, all ground transportation (outside of local airport transfers in the Caribbean), flights, travel insurance, passenger tariffs or duties, airline fees, surcharges, airport fees, baggage fees, service charges or facility charges, personal charges at lodging, security fees and taxes. Holiday insurance, Covid tests, Visas and ESTA’s are also not included and must be purchased before travel, if required.

• d. Prize winner and their travel companion must be over 18.

• e. Passports are required for international travel and must have at least six months validity from when your trip finishes (i.e. the date you travel home).

• f. The Holiday cannot be taken during peak seasons and cannot be confirmed until 90 days prior to departure. Blackout dates and restrictions apply. Sandals Resorts’ Blackout dates include but are not limited to:, 17th – 23rd February 2024,  11th March – 16th April 2024, 18th – 29th November 2024, 18th – 31st December 2024, 1st – 3rd January 2025, 14th – 17th February 2025, 17th April – 4th May 2025, 1st – 7th July 2025, 24th – 30th November 2025, 21st – 31st December 2025. Once dates are confirmed there will be an administration fee for any changes made to the reservation.

• g. The Sandals Prize Package must be redeemed before 31st January 2025.  The Sandals Prize Package is strictly non-transferable; no cash alternative is available, and the prize cannot be redeemed for cash. If the winner is unable to redeem the prize within the specified time the prize will be forfeited.

• h. Sandals Resorts are for couples and all accommodations include one king size bed.

• i. The prize is subject to Sandals Resorts terms and conditions accessible here: https://www.sandals.co.uk/terms-conditions.

• j. Sandals Resorts reserves the right to relocate and/or substitute the selected resort for another resort in the Sandals Resorts chain in a similar category based on availability of space for the secured travel dates, and to change dates without prior notice for any circumstance(s) beyond the selected resort’s control and if such circumstance(s) so require. The Terms and Conditions agreed to shall apply with equal applicability to any resort, which is the subject of substitution or deviation.  Neither the Promoter nor Sandals Resorts shall be liable for any claim made whatsoever, including but not limited to loss, compensation, or refund by reason of such substitution or deviation.

• k. There is no cash alternative to the prize stated and the prize must be accepted by the named winner. The prize cannot be transferred to anyone else.

• l. The Promoter reserves the right to provide an alternative prize of equal or greater value should circumstances outside its control make this necessary.

• m. Health and Safety. The health and safety of our guests is a priority.  Sandals Resorts reserves the right to implement or modify health protocols, policies and procedures at any time as needed, in keeping with public health guidance and applicable law.

• n. Guests are responsible for checking the travel and entry protocols for the destination that they are travelling to before they depart and ensuring that they fully understand and comply with any such protocols. For example, some destinations may require all guests to be fully vaccinated and/or to obtain a negative PCR Covid-19 test a certain number of days pre-travel and post travel, to return to your original destination. Please visit the UK Foreign Commonwealth and Development Office (“FCDO”) website before travel and check the official Government website for the country you’re visiting for all pre and post travel protocols. The Promoter and/or Sandals Resorts. shall not be responsible for any additional costs incurred for any required test or any other pre-travel or post-travel requirements.

• o. Compliance With Government Entities: The Promoter and Sandals Resorts and/or any of their related entities shall have the right to comply with any and all orders, recommendations, or directions whatsoever given by any government entity or by persons purporting to act with such authority, and such compliance shall not be deemed a breach of any agreement or any agreement entitling the guests to assert any claim for liability, compensation or refund.

10. Prize Delivery

• a. It is the responsibility of the entrant to provide their correct, up-to-date details when confirming acceptance of the prize in order for their prize claim to be processed. The Promoter cannot be held responsible for the winner failing to supply accurate information which affects prize acceptance or fulfilment of their prize.

• b. The Promoter will arrange the Prize within 28 working days of winner’s claim.

11.  General

• a. If the Promoter suspects that an individual has breached these terms and conditions, the Promoter reserves the right to verify the winner and to ask for proof of identity, age and address and that they are the person associated with the winning notification.

• b. Winner may be asked to take part in reasonable publicity relating to this prize draw without payment. Such publicity may include, without limitation, publishing the winners’ name and social media handle Instagram, and any statements made by them concerning the Prize Promotion and the Prize won as part of the Prize Promotion Sandals Resorts’ social media channels.

• c. PRIVACY POLICY/USE OF DATA:  The Data Protection Act 2018 provides a number of protections for collection and use of your personal data.  Any personal data collected from the Prize Winner and travel companion for Prize redemption purposes shall be subject to the Promoter’s privacy policy located at www.sandals.co.uk/general/privacy/.  The Promoter will only use the personal data of the prize winner and travel companion for the purposes of administrating the Prize redemption, unless the Prize winner and travel companion provide express consent signifying their agreement to any other processing or use of their personal data.  For Prize redemption purposes the personal data collected from the Prize winner and travel companion will be shared with the Promoter’s reservations affiliate and the resort which are both located outside of the United Kingdom

• d. Each Entrant agrees and as a condition of possibly being awarded the Prize to release and hold harmless the Promoter and its affiliated companies and each of their respective officers, directors, employees, agents, successors, assigns and insurers from and against any and all claims, causes of action and/or liability for any injuries, illness, death, loss or damage of any kind arising from or in connection with participation in and/or entry into the competition or receipt or possession, use or misuse of the Prize or any element thereof

• e. CLASS ACTION WAIVER THIS SECTION PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION AND SUPERSEDES ANY LAW ENTITLING GUEST TO PARTICIPATE IN A CLASS ACTION. THIS CLASS ACTION WAIVER PRECLUDES GUEST FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING ANY CLAIM BROUGHT UNDER AS A RESULT OF ANY AGREEMENT. EVEN IF APPLICABLE LAW PROVIDES OTHERWISE, GUEST AGREES THAT ANY ARBITRATION OR LAWSUIT AGAINST ANY ENTITY UNDER THE UNIQUE GROUP AND/OR SANDALS RESORTS WHATSOEVER SHALL BE LITIGATED BY GUEST INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS ACTION, AND GUEST EXPRESSLY AGREES TO WAIVE AUTHORITY TO ARBITRATE CLAIMS ON A CLASS ACTION BASIS. IF GUEST'S CLAIM IS SUBJECT TO LEGAL PROCEEDING UNDER FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE ACCOMMODATIONS, AMENITIES, TRANSPORATION AND OTHER PRODUCTS OR SERVICES TERMS AND CONDITIONS (available here: www.sandals.co.uk/terms-conditions/), THE GUEST FURTHER AGREES AND ACKNOWLEDGES THAT THE CLASS ACTION WAIVER IS MATERIAL AND ESSENTIAL TO THE PROCEEDING OF ANY DISPUTES BETWEEN THE PARTIES AND IS NON-SEVERABLE FROM THE AGREEMENT TO ANY CLAIMS HEREIN. THE VALIDITY AND EFFECT OF THIS CLASS ACTION WAIVER MAY BE DETERMINED ONLY BY A JUDGE OR COURT OF LAW. GUEST AGREES THAT THIS SECTION SHALL NOT BE SEVERABLE UNDER ANY CIRCUMSTANCES FROM THE FORUM SELECTION AND CHOICE OF LAW PROVISION SET FORTH IN THE TERMS AND CONDITIONS. Guest agrees that the parties referenced in FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE TERMS AND CONDITIONS that may be the subject of any claim by Guest can receive immediate judicial assistance to enforce this class action waiver.

• f. The surname and county of the winner will be made available to anyone who requests it by emailing pressoffice@sandals.co.uk  by 29th February 2024. Participants may request their surname and county is not published in the event they win by emailing pressoffice@sandals.co.uk before the Promotion Period end date. However, the Promoter shall provide the surname and county of the winner to competent authorities upon request from such competent authorities (including the Advertising Standards Authority). 

• g. This Prize Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. You understand that you are providing your information to the Promoter and not to Instagram. All entries are also subject to Instagram’s terms of use, and you can find them here https://help.instagram.com/581066165581870.

• h. The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this promotion for whatever reason, with no liability to any entrants or third parties if the failure to deliver our obligations is outside our reasonable control. However, if this happens, the Promoter will use all reasonable endeavours to avoid consumer disappointment.

• i. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to winner notification or prizes. The Promoter or its agencies will not be responsible for the non-inclusion of entries, including any such failure which is within the control of The Promoter or its agencies.

• j. Each Entrant agrees and as a condition of possibly being awarded the Prize to release and hold harmless the Promoter and its affiliated companies and each of their respective officers, directors, employees, agents, successors, assigns and insurers from and against any and all claims, causes of action and/or liability for any injuries, illness, death, loss or damage of any kind arising from or in connection with participation in and/or entry into the competition or receipt or possession, use or misuse of the Prize or any element thereof.

• k. The application and interpretation of these terms and conditions shall be governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them.

• l. These Terms and Conditions contain the full and complete understanding with respect to this Prize Promotion and supersede all prior and contemporaneous agreements, representations and understandings, whether oral or written. The headings herein are for convenience only, do not constitute a part of these Terms and Conditions, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Terms and Conditions shall be effective unless in writing and signed by the Promoter. The waiver by the Promoter of any provision of these Terms and Conditions shall not constitute a waiver of any other provision herein.  The rights and obligations hereunder may not be assigned by a participant, whether by operation of law or otherwise, and any attempted assignment in violation of the foregoing shall be null and void. These Terms and Conditions shall be binding upon, and inure to the benefit of, the permitted successors and assigns of the Promoter. 

• m. Participation into the Prize Promotion is at the participant's sole risk. To the extent permitted by law, the Promoter does not accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by participant's or any third parties arising out of or in connection with the Prize Promotion, the fulfilment and/or fulfilling the requirements and/or accepting the Prize.
